OVERSEAS PARTNERS – MARRIAGE WITHIN AUSTRALIA

It is no longer a matter of marrying an overseas person and that person being allowed to live in Australia as your legal spouse.  There is an immigration process to be followed before the partner will be granted residency.  You can visit the Department of Immigration website  to obtain information regarding immigration requirements. 

The legal requirements for a legal marriage in Australia remain the same and need to be met.

You should seek advice from the Department of Immigration or a migration agent to commence the process to obtain permanent residency for your partner before you marry to ensure that your partner will be able to reside in Australia.  Any previous criminal history or health problems may be reasons to preclude your spouse from being granted residency.
